1. TERMINOLOGY USED & ITS MEANING
1.1. “Gypsy Snowboarding” hereinafter refers to Gypsy Snowboarding Ltd and its team of Instructors.
1.2. “Client” or “Clients” means the person making the booking, or person/s taking part in Gypsy Snowboarding lessons/Gypsy Trips/free events/competitions/coaching/instruction.
1.3. “Booking” means the booking request made by a client, whether made online, by telephone, by email or messenger style mobile application i.e. Instagram, WhatsApp, Facebook.
1.4. “Booking Confirmation” means the email confirmation received by the client sent by Gypsy Snowboarding, upon receipt of correct payment outlined in the clients invoice to secure the clients booking.
1.5. “Booking Confirmation Form” refers to the form the client will receive upon receipt of correct payment for bookings made to Gypsy Snowboarding.
1.6. “Deposit” means the non-refundable deposit required to secure your booking with Gypsy Snowboarding outlined in your invoice. See payments section for full deposit/payment details.
1.7. “Invoice” means the unique invoice sent to the client from Gypsy Snowboarding after the client has made a booking request, if a deposit has been paid the invoice will be resent to the client when the outstanding balance is due.
1.8. “Lesson” or “Lessons” refers to any Gypsy Snowboarding Private Lesson, Group Lesson, Free Event, Locals Only Lesson, Gypsy Trips, Girls Shred Day ,Freshies Session, Coaching Session or Course.
1.9. “Minor” or “Minors” refers to any client under the age of 18 taking part in a lesson or lessons with Gypsy Snowboarding.
2. GENERAL
2.1. The client, and anyone they are booking on behalf of, should read and understand these Terms and Conditions. Upon receipt of full payment or payment of deposit amount stated on the clients invoice, the client is agreeing to be bound by these Terms and Conditions.  Additionally the client placing the booking will be asked on their Booking/Medical Confirmation Form to agree to be bound by these Terms & Conditions. If the client declines then the booking cannot be secured or completed by Gypsy Snowboarding and their booking will be cancelled.
2.2. Gypsy Snowboarding will keep all clients personal information private & confidential.
2.3. Details of what is included in the price is clearly stated on the relevant pages of our website, www.gypsysnowboarding.com.
2.4. Prices may be subject to change at any time but will not affect the price given at the time of the clients booking enquiry.
2.5. Helmets are compulsory on all lessons. Clients will be refused from lessons if they do not have one. Helmets are not provided/supplied by Gypsy Snowboarding.
2.6. Lift passes are obligatory and are not provided by Gypsy Snowboarding unless clearly stated otherwise.  Lift passes are not included in the price of any lesson unless clearly stated otherwise.
2.7. Clients must supply their own snowboard equipment required for lessons, this includes helmet, clothing, snowboard, bindings, boots, goggles & any specific safety equipment.
2.8. Gypsy Snowboarding reserves the right to refuse a client from the lesson for any of the following:
  • The client is found to exhibit behaviour, which is deemed to be inappropriate and/or detrimental to themselves, others in the group or Gypsy Snowboarding Instructors
  • The client appears to be under the influence of alcohol or drugs
  • The client is inappropriately dressed, in ill health, or not at the correct ability level for the group
2.9. If a client is refused from a lesson for any of the reasons listed in section 2.7. Gypsy Snowboarding reserves the right to offer zero refund/credit note to the client.
2.10. If the client agrees to be in any picture or video content taken during lesson time they consent to content being used used by Gypsy Snowboarding for promotional content on social media channels or via the Gypsy Snowboarding website.
2.11. Any free vouchers provided by Gypsy Snowboarding for charitable events, online competitions or other giveaways are not redeemable during peak weeks of the winter season, this includes all school holiday periods.
2.12. Clients running late for Private Lessons need to contact Gypsy Snowboarding on the number provided on their booking confirmation email. No extra time can be added onto the end of the allocated lesson time due to this affecting the next scheduled lesson of the day.
3. PAYMENTS
3.1. Full payment must of been received before the start of the lesson/booking.
3.2. Lessons are not fully confirmed until full payment of the booking has been received.
3.3. A non-refundable deposit of 20% of the total cost of the booking is required to secure a booking. The deposit is non-refundable as it covers administrative costs and fixed overheads. A booking will only be secured when deposit amount has been received and fully confirmed once full payment has been received. If a 20% deposit has been paid the final balance is due 6 weeks prior to the start of the clients first lesson date.  This is unless the client is booking onto a Gypsy Trip(s), Gypsy Trips fall under the payment, cancellation Terms & Conditions of the chalet company/holiday provider the specific Gypsy Trip(s) is partnered with.
3.4. Failure to pay the remaining balance 6 weeks prior to the start date of the lesson will forfeit the clients lesson, without refund of any deposit paid.
3.5. Bookings made within 6 weeks of the lesson start date the full balance must be paid at the time of booking to secure/confirm the booking.
3.6. All bookings must be paid via bank transfer, credit card or debit card to the Gypsy Snowboarding bank account outlined on the clients invoice.  Any charges incurred for bank transfers/credit card/debit card payments must be paid for by the client, Gypsy Snowboarding takes no responsibility for bank charges incurred by the clients bank, credit card or debit card provider.
4. CANCELLATIONS (NON COVID-19 RELATED)
4.1. Gypsy Snowboarding reserves the right to cancel bookings/lessons.  Full refunds of bookings/lessons cancelled by Gypsy Snowboarding will be made in this instance.
4.2. All cancellations by clients must be received in writing via email to bonjour@gypsysnowboarding.com with the subject field filled in with ‘Cancellation Request’, so as Gypsy Snowboarding can treat it as an urgent email.
4.3.  All cancellations of bookings/lessons made by the client will incur the following fees;
  • 6 weeks or more prior to the confirmed lesson = 20% loss of total booking
  • Between 6 – 2 weeks prior to the confirmed lesson = 50% loss of total booking
  • Between 2 – 1 week(s) prior to the confirmed lesson = 75% loss of total booking 
  • 1 week or less prior to the confirmed lesson = 100% loss of total booking
4.4. Gypsy Snowboarding cannot offer refunds for lessons not attended due to injury, illness or late arrival.  In the result of these instances Gypsy Snowboarding will offer documentation of proof of purchase of the clients booking to make the correct claim from the clients insurance provider, see section 6 for insurance terms.
5. INSURANCE
5.1. Gypsy Snowboarding is not responsible for its Clients’ insurance. It is a requirement upon booking that clients have adequate insurance cover before travelling, for themselves and everybody they book on behalf of.
5.2. Insurance should cover at least the following: Winter sports and off-piste skiing/snowboarding, Emergency Medical Expenses including, amongst other costs; ambulance charges and repatriation; Pandemic and epidemic cover including Covid-19, including but not limited to additional costs if self-isolation is required during or following the clients stay. Cancellation of the clients trip or curtailment cutting short the clients trip including but not limited to contracting coronavirus; Personal Liability to include, amongst other liabilities. Travel and transfer delays which must include amongst other costs; additional costs incurred in the event of a delay.
5.3. Gypsy Snowboarding reserves the right to cancel a booking or terminate participation in a course at its sole discretion if it is not satisfied with a client’s (or any member of its party’s) insurance arrangements and the suitability of such arrangements for the booking.
5.4.  It is the responsibility of the client to source the relevant insurance, Gypsy Snowboarding will take no responsibility for advising insurance options available.
6. OPERATIONAL INTERRUPTIONS (NON COVID-19 RELATED)
6.1.  If the resort is open, or partly open, the services will be delivered as planned to the extent available. Gypsy Snowboarding instructors will use the open areas available to them to deliver the lessons in a manner that ensures the clients’ safety.
6.2. Interruptions in ski resort operations are completely outside of the control of Gypsy Snowboarding.  Where decisions made by the ski resorts impact delivery of our lessons, the client will not be entitled to any refund, indemnity compensation or discount. Such situations may include, but are not limited to, the following: technical malfunction, strike, adverse weather conditions, avalanche, excess or insufficient snow cover, power failure, disease outbreak, epidemic, resort closure and/or volume restrictions on visitor numbers. Gypsy Snowboarding will not be liable to the client for any such event, but we will provide you with the relevant documentation to support a claim with your insurance policy provider.
6.3. The client acknowledges and agrees that participation in lessons may require a certain amount of flexibility. The schedule for lessons, as stipulated on the clients Booking Confirmation Form, is an indication of Gypsy Snowboarding’s intention rather than a contractual obligation. Unforeseen local conditions or events may sometimes necessitate changes to the itinerary and could mean that some activities are not possible.
7. GROUP LESSONS
7.1. Gypsy Snowboarding reserves the right to cancel any group lessons if the required number of participants to run the course is below the amount stated in section 8.2.
7.2. Gypsy Snowboarding’s group lessons require a minimum of 4 clients for the course to run for the full specified duration. Where we have less than 4 clients booked on a group course, we will still try to run the course, as detailed below:
  • 3 clients booked onto a course – 5 day course reduced to 4 days / 4 day course reduced to 3 days
  • 2 clients booked onto a course – 5 day course reduced to 3 days / 4 day course reduced to 3 days
7.3. In the instance of 1 client being the sole booker onto a set of group lesson the client will be contacted 4 days prior to lesson start date and arrangements can be made to turn the booking into Private Lessons to the value already paid.  The client can add to this booking if preferred, the client also reserves the right to cancel the group lesson booking and receive a full refund of amount paid.
7.4. Instructors will wait no longer than 10 minutes for late clients attending group lessons. Before leaving the meeting point they will phone the client on the number provided on the booking/medical form filled out at time of booking. If running late clients should contact the instructor immediately on the mobile number provided on the clients Booking Confirmation email.
7.5. In the event that the client does not have the required skill or fitness level for a group course, they will be unable to participate in the course. This will be deemed to have cancelled the course and the client will not receive a refund for value paid.
8. Liability
8.1. The client acknowledges and agrees that snowboarding is a hazardous activity that carries the risk of personal injury and they undertake snowboarding at their own risk. Gypsy Snowboarding will not be held responsible for death or any injury, losses or accidents however they may occur, other than as a result of Gypsy Snowboarding’s negligence.
8.2. The client has the right to decline taking part in activities they deem may endanger their health and safety, or which are not covered by their insurance policy. The client agrees and acknowledges that Gypsy Snowboarding will not be held liable for any injury or damage caused to them or any member of its party where that person has taken a risk willingly, and the injury or damage arose other than as a result of negligence by Gypsy Snowboarding.
8.3. Gypsy Snowboarding will not be held responsible for any theft, loss or damage of its clients’ personal belongings.
9. Minors / under 18's
9.1. It is the responsibility of the parent/guardian in resort to drop off the minor in time for their lesson and to be on time to collect the minor at the pre-arranged meeting point at the end of the scheduled lesson time.
9.2. Parents/guardians of the minor have to be at the pre-arranged meeting point at least 10 minutes prior to the end of the lesson time to guarantee collection of the minor on time.  If the parent/guardian is late for the collection of the minor Gypsy Snowboarding reserves the right to charge the client the current hourly rate of a Private Lesson (2hr lesson cost halved).
9.3.  Gypsy Snowboarding reserves the right to refuse a minor for a lesson that is not in the appropriate clothing, no refunds will be given for the loss of lesson.
9.4. Gypsy Snowboarding strongly recommends that all minors under the age of 18 wear a helmet for their lesson.  This is not a legal requirement but a recommendation.
10. MEDICAL TREATMENT & INFORMATION
10.1. By agreeing with Gypsy Snowboarding’s Terms & Conditions you are hereby consenting to the following;
  • The Client (the attendee or parent/guardians of attendees under the age of 18) hereby consents to emergency medical treatment being provided to the attendee and authorises any Gypsy Snowboarding instructor to sign any authorisation or consent to medical treatment that may be required by the health care provider. All reasonable steps will be taken to contact the parent, guardian or emergency contact in the event that medical attention is required by the attendee. The client agrees to pay all costs associated with such medical care or attention and related transportation.
10.2. It is the responsibility of the client to provide Gypsy Snowboarding with any medical information, including medication, pre or existing injuries that the client taking part in the lesson may have.  Any medication that is needed during the lesson must be kept on the person of the client taking part in the lesson.  This information can be given on Gypsy Snowboarding on the Booking Confirmation Form sent to the client upon receipt of payment/deposit.
11. COMPLAINTS
11.1. If the client feels like they have received any kind of unsatisfactory service from Gypsy Snowboarding then they should inform us straight away and we can hopefully address the situation to the satisfaction of the client.
11.2. Gypsy Snowboarding cannot accept complaints regarding the weather conditions or operational standards of the resorts where clients lessons are planned, these situations are outside of the control of Gypsy Snowboarding.
